8000 ordering the government permit to Mining Companies

Jakarta-The government is trying to curb the 8000 permit for a mining company that is still relevant overlapping implementation of Act N0 4 / 2009 on Mineral and Coal (UU Minerba).

"Regarding the overlapping licenses that have to be disciplined, were reported from 8,000 permits, there are 6000 that overlap. Earlier we agreed to set up a team to overcome it," said Coordinating Minister Hatta Rajasa after a coordination meeting in Jakarta on Monday. He added that the team will be under the Ministry of Energy and Mineral Resources in coordination with the Ministry of Interior.

Hatta explained that the problem of overlapping licensing is in addition to reducing state revenue, could also disrupt the ecological balance in the region around the mine. "The point is we do not want to damage our environment, we want to report work, we want the level of state revenue, level of social welfare in the region (increasing) but we do not want to damage the environment," he said.

He pointed out the licensing issues that often happens is the company that has been granted permission to conduct mining activities by local governments, but the permit can be transferred to another company if the regional leaders in the region changed. "For example there is permission given to company A because either replace regent or something given to company B, noisy. There is another industrial timber estates (HTI), there are mines given permission (for) two-three companies, this happened," said Hatta .

Finance Minister Agustin Martowardojo ensure there will be 8000 which requires licensing verification and audit to ensure all mining companies have been operating with the principle of protecting the environment and obey the rules so that the mandate of the Mining Law can be achieved.

"Therefore we discussed earlier and will be followed up in concrete form the team that issued a policy to ensure all can be fulfilled," he said. In addition, enforcement of licensing are expected to be beneficial to the state revenue because of tax revenue can be more disciplined.

"We do not want to attempt to achieve what is mandated by the Mining Law is not reached, and we do not want any liability to the state in the form of paying such ground rent, paying royalties and taxes it is not orderly, we even worry there is no orderly export within the meaning of illegal, "he said.

Finance Minister expects the presence of this control, coordination between central and local governments can more effectively so that raises the legal certainty and mining companies can contribute to develop hilirisasi industry. "We need synergy between central and local governments in particular to ensure compliance with guiding principles mining businesses in the aspect of protecting the environment and maintain the obligations of countries do well," he said.
